In most Northern Ontario municipalities, fire pits must be at least 3 metres (approximately 10 feet) from any structure, property line, fence, or overhanging branches. Setback requirements vary by municipality, so it is important to check your local bylaws before building. Martin Services designs and builds fire pits across Powassan, North Bay, Callander, and surrounding communities, and we ensure every installation meets or exceeds local fire safety regulations.

Municipal Bylaws in the Nipissing District

Each municipality in the Nipissing District has its own open-air fire regulations. Generally, recreational fire pits must be set back at least 3 metres from any building, property line, fence, hedge, or overhead wires. Many municipalities also specify maximum fire pit dimensions — typically no larger than 24 inches in diameter for wood-burning pits — and require a non-combustible surround. Some areas require a burn permit for open fires, even in a contained fire pit. Propane and natural gas fire pits often have different (and usually more relaxed) setback requirements since they produce no sparks or embers.

Safety Beyond the Bylaws

Meeting minimum setback requirements is just the starting point. Martin Services recommends additional safety considerations based on our experience building fire pits across Northern Ontario. We suggest placing fire pits on non-combustible surfaces like stone patios or gravel pads rather than directly on grass or wooden decks. Wind patterns matter too — positioning the fire pit where prevailing winds carry smoke away from your house and seating area makes for a much better experience. We also recommend keeping a 10-foot radius clear of any combustible furniture, decorations, or landscaping materials like mulch.

Permit Requirements

Some municipalities require a permit or registration for fire pits, while others simply require compliance with the bylaw. In the Municipality of Powassan, for example, you may need to notify the fire department. In North Bay, open-air burn bylaws are enforced by the fire prevention office. Martin Services handles the research for your specific location and ensures your fire pit installation is compliant. With 35 years of experience, we have built fire pits in every municipality across the region and know the local requirements.
